STATUS OF RESIDENCE APPLICATION SUPPORT
WHAT IS THE "STATUS OF RESIDENCE" SYSTEM?
Each country is free to decide whether to allow foreigners to enter or leave the country. This principle has been established as international customary law. Therefore, each country establishes and applies its own immigration control system that suits its needs. Japan has adopted a "residence status" system, which specifies the content of activities for the purpose of residence by law and allows only those who meet the requirements to enter or stay in Japan. This system is modeled on the American "immigration law" and is widely used in countries in the Americas and Asia.
IMMIGRATION CONTROL SYSTEMS AROUND THE WORLD
Defence & Security Type | Europe Type | America Type |
---|---|---|
Control system focused on maintaining security by police and other law enforcement authorities |
No strict procedures for entering and residence, but strict restrictions on employment of foreigners. |
Specifically define the purpose and scope of residence activities by law |
China, North Korea, former Soviet Union countries, etc. |
European countries with the Schengen Agreement, etc. |
Americas, Japan, Asian countries, etc. |
In Japan, the "Immigration Control Ordinance" was enacted in 1951 as the law governing the content of the status of residence system, and after continuous amendments, it still operates today as the "Immigration Control and Refugee Recognition Act" (Immigration Control Act). The basic idea remains the same: only those who meet the "status of residence" prescribed by the Immigration Control Act are allowed to enter and stay in Japan.
(Note) About the name "VISA"
The qualifications for foreign nationals to stay and work in Japan are often referred to as "work visas" or "visas". However, this is not correct and it should be called "residence status" in Japan's immigration system. On the other hand, "visa" correctly means the one issued by the Japanese consulate abroad and affixed to your passport to certify that your entry into Japan is lawful. Please note that in some parts of our website, the word "visa" is used for "residence status" because this is how it is commonly used in reality.
TYPES OF STATUS OF RESIDENCE
The types of status of residence are specified in the Immigration Control Act as shown below. In order for a foreigner to enter and stay in Japan, he/she must be recognized as having one of the following statuses of residence. WHAT IS "CERTIFICATE OF ELIGIBILITY"
Effective when hiring foreigners residing overseas !
Certificate of eligibility |
In order for foreigners to land in Japan, it is necessary for them to have a visa issued in their passport, but applying for a visa can take up to 2-3 months, which is a big problem. The "Certificate of Eligibility" system was enforced to resolve such problems. The Certificate of Eligibility is a document issued by the Ministry of Justice to prove that foreigners before coming to Japan comply with the landing standards stipulated by the Immigration Control Act and that the purpose of stay(occupation) corresponds to the status of residence. If you have the Certificate of Eligibility, the visa will be issued in a short time, and it will be a very effective means when you invite foreigners on a fixed schedule for employment etc. We support application for issuance of Certificate of Eligibility. |

WHAT IS "WORK QUALIFICATION CERTIFICATE"
Effective when a foreign national changes jobs in Japan !
Work qualification certificate |
When a foreigner changes jobs in Japan, the status of residence before changing jobs will not be valid after the change, even if the occupations are similar, as the company itself is one of the judgment factors. If you are too optimistic, renewing of the status of residence may be denied after changing jobs, and you may be forced to leave the country.
In such cases, issue a "Certificate of Eligibility" on the premise of working at the new company, to confirm that the status of residence will be continuously obtained even after changing jobs. We support application for issuance of Certificate of Eligibility.
